I agree, but in belgium (and many other countries) the laws have gone "extreme left" (socialism to the max) and its almost impossible to select people based on physical things.
(altough, in europe its not so easy to start lawcases, like in the usa, where they start lawcases for the most idiotic things)
Its, for example, forbidden to select based on gender.. but in some fields you need this.. most females lack certain power that is needed in certain jobs...
And most people think: well it doesnt matter, in the end females wont come for such a job.. and they are often right, but and thats the big issue: because the law is there , you (the boss, the company) needs to adjust his company to house both males and females.. even knowing for 100% sure females wouldnt show up or if they do, they will quit after 1 week or something like that.
It costs money and time, time and money you waste on people that are not qualified for the job, but that you cant refuse because the law states it.
Also: what is a lie? If you leave something out, you are not really lying + the law states that you do not need to tell personal information etc... so in the end its a "legal" thing , all about the law and not about the right qualifications for the job.
yes to leave out something is allowed and not a lie (handicap, pregnancy, whatever), but that person replied to a question that he stuttered because he was nervous and not that it's a general problem...for me it's a lie...
anyway usually the company can find many reasons to kick people out and use then an issue that is neutral....and in the trial period it's quite easy anyway. I'm not sure but do you need to give reasons anyway in that time?
I guess a problem might only be nasty people that search for job advertisements with obvious shortcomings, apply for the job and then sue, in any way either because they don't get the job or if, because they're fired quite fast then...
and I guess what you wrote is mostly a problem for small companies, anyway there are not so many jobs in small companies with work that needs lots of power (and the bigger ones have then robots, robot arms, cranes for this, because otherwise the workers' council will sue them for unhealthy working conditions
). But even the very inflexible and stubborn military here managed it without much problems, before they complained a lot that they're not prepared for women and all that, and now they don't want to miss them, even on ships).
Anyway it's surely a problem as you have to select and therefore discriminate people by traits and qualifications and there are border cases and people who exploit this in both directions...
